Beacon Learning Client Service Agreement

This is the Client Service Agreement for Beacon Learning stipulating the rights and obligations of service between Beacon Learning and the client. Hereinafter, Beacon Learning will be referred to as “the Provider” and you and your child will be referred to as “the Client”. To successfully complete the registration process, you must agree to all the terms of this agreement and follow the instructions and prompts on this page. Successful registration will be deemed an acceptance of this agreement. Please read the following terms carefully.

Relevant Rights and Responsibilities

1. The Provider promises to respect and protect the Client's privacy, and the Provider will not publish any information related to the Client without the authorization of the Client unless there are legal or procedural requirements.

2. To protect the rights of both the Provider and the Client, the Provider has installed video monitoring devices in the Beacon Learning Center and will maintain a record of events for the duration of 2 months. If there are circumstances requiring the use of recorded footage, both parties have the right to request and view segments of the recording.

3. The Provider will take photos and videos during sessions for internal review and to record learning progression, which will only be used by the Provider for the purposes of teacher training and student progress. The Client’s information will not be disclosed to anyone unaffiliated with Beacon Learning. The Client’s permission must be obtained if the photos and videos or the client’s likeness are used for other purposes.

4. If the Client experiences harm or injury arising from the Provider's oversight or faulty equipment and facilities, the Provider shall bear the relevant responsibilities and assume any related liabilities.

5. If the Client's actions cause material damage to the Provider’s equipment or physical harm to the Provider, the Provider has the right to claim reasonable compensation from the Client.

Assessment

1. The Client must remit payment for the evaluation fee before or on the same day as the scheduled evaluation.

2. The Client must fill in three forms before the assessment: Beacon Learning Parent Questionnaire, Sensory Learning Optimization (SLO) Survey- Parent Version, and Behavior Rating Inventory of Executive Function 2 (BRIEF-2) – Parent Version.

3. The Provider will provide the Client with the 《Sensory Learning Optimization Report》 3-4 weeks after the assessment. Any changes to the timeline for delivery of the report will be communicated explicitly by the Provider to the Client.

4. The《Sensory Learning Optimization Report》 will not provide diagnostic conclusions for the Client. It is a learning profile based on our analysis of the Client’s sensory motor profile, cognitive processing abilities, executive functions, etc.

Payment

1. The Provider will offer a Learning Plan based on the learning goals of the client and assessment findings.

2. The Provider will share with the Client the recommended frequency and duration of sessions and coordinate with the Client to confirm scheduling and pricing that is best suited to working towards the Client’s desired outcomes.

3. The Provider accepts payment in three forms: WeChat Pay, Alipay, and bank transfer. Exceptions to these options may be accepted but must be communicated in advance.

4. The Client needs to pay the first month in advance. Subsequent payments will be calculated and billed on the 5th of each subsequent month and cover the cost for services rendered the month prior. Payment must be submitted before the 15th of the current month. The Provider has the right to postpone services after two consecutive months of lapsed payments. Allowances can be made for extenuating circumstances that are communicated in advance.

4.1 By default, the client shall pay on a monthly basis based on the number of sessions scheduled each month. If the client wishes to prepay for a course package, this must be mutually discussed and agreed upon with Beacon Learning. In the case of a prepaid package, upon termination, Beacon Learning will calculate the completed sessions based on the original unit price and refund the remaining balance for unused sessions.

5. Cancellations made 48 hours in advance (telephone, email, or WeChat notification is sufficient) will be honored and will not be billed. There will be a 30% cancellation fee if the Client notifies the Provider between 48 hours and 24 hours, and a 50% cancellation fee if notified within 24 hours.

6. The Provider provides a team of qualified and experienced professional learning specialists and will match 2-3 suitable specialists for the Client who will be well informed of the Client’s learning progress and each able to lead sessions independently with the Client. If a minimum of two teachers are required each session to fulfill the learning goals, the fee will be calculated at 1.6 times the original quoted fee.

7. The Provider will provide a professional learning center for sessions to be held. If the Client prefers to arrange for sessions to be provided at an alternate location, the alternate location must fulfill requirements articulated by the Provider and a transportation fee will be charged based on the table below.

8. A transportation fee is calculated based on the distance from the learning center to the location provided by the Client. The billing table is below.

Classes

1. The Provider will provide the first formal learning report between 15-20 sessions. Subsequent reports will be provided regularly every semester (6 months). The Client can request additional reports from the Provider when necessary.

2. The Provider will prepare and share additional teaching materials with the Client according to the Client’s learning needs. These teaching materials provided by the Provider are meant only for the Client's use, and the Client shall not share the internal materials with others or lend them to others for use.

3. The Client can request family consultations to better support the Client’s developed conducted over the phone or at the learning center. Each month, the Client is entitled to one free consultation.

4. The Provider offers support to coordinate efforts with other teachers and institutions, such as helping the Client confirm the content of the Client's IEP, or assisting in communicating with the Client's school or teacher.

5. If the Client refuses to comply with the methods and recommendations of the Provider, the Provider is not responsible for the failure to achieve the desired learning outcomes.

Termination

1. Service will be terminated upon completion of the mutually agreed learning plan. If the learning objectives are updated by both parties, a new learning plan, including, for example, the schedule for the sessions, frequency of sessions, and course fees, will be established.

1.1 The Client must notify the Provider of their intention to terminate services at least one session in advance. For the pay-per-session model, no further fees will be incurred after termination. For the prepaid package model, refunds will be issued based on the original session rate, as stated in the payment terms above.

2. If the Client wishes to terminate the service agreement in advance of the learning plan, the Client must notify the Provider one session in advance so that the Provider can summarize and celebrate the progress made by the Client. A full learning summary and recommendations will be provided 3-4 weeks after the final session.

Other

1. This agreement constitutes the complete service agreement between the two parties and other related matters. Except for the provisions of this agreement, no other rights are granted to the parties to this agreement.

2. If any provision of this Agreement is invalid or unenforceable for any reason, the remaining provisions of this Agreement shall remain valid and binding.

3. There is an English and Chinese version of this agreement. If there is conflict between the meaning and intent of the different versions, we will defer to the Chinese agreement.
